Donald Trump’s indictment is unprecedented. It shouldn’t be

Gerald Ford’s pardon of Richard Nixon ingrained a flawed view of rule of law in the minds of many Americans.

In the words of American humorist Mark Twain, history doesn’t repeat itself, but it often rhymes. On 8 August 1974, Richard Nixon delivered what was surely the most difficult speech of his political career. After two years of investigation into the Watergate scandal, the US president addressed the nation to announce that he could no longer perform the duties of his office and must “put the interest of America first” by resigning. This moment marked a significant turning point in American politics, a shift that many hoped would restore trust in government.

Nixon’s resignation was largely supported not only by the American public but also by his own Republican Party. Even conservative commentators, who typically backed him, began to recognize the inevitability of his departure. In the last Gallup poll before he resigned, only half of Republicans gave him a positive approval rating, and 31 percent favored his resignation. Senator James Buckley, writing for the National Review, argued that Nixon’s declining popularity showed a “cumulative loss of faith” in his ability to lead, leading to a “moral authority” crisis.

However, this moment in history took a turn when his successor, Gerald Ford, offered Nixon a full pardon, a decision that some critics argue ingrained a flawed view of accountability in the minds of many Americans. By pardoning Nixon, Ford avoided a prolonged national crisis but also set a precedent that might have undermined the rule of law. For many, Ford’s decision contributed to the idea that high-ranking officials could be immune from prosecution, a sentiment that might have impacted public expectations of legal accountability for future leaders.

Fast forward to today, and Donald Trump faces unprecedented legal challenges. His indictment represents a significant moment in American political history, yet it should not be an anomaly. Trump’s case, despite its high profile and political implications, is part of the larger struggle to ensure that no one, not even a former president, is above the law. In contrast to the past, the legal system should hold all individuals accountable, regardless of their political position or influence.

If Trump’s indictment is perceived as an exception rather than the rule, the precedent set by Ford’s pardon of Nixon could continue to perpetuate the idea that powerful individuals are somehow exempt from the legal processes that govern ordinary citizens. Such a view could weaken public trust in the judiciary and the principles of equal justice under the law. This is why the current indictment, as unprecedented as it is, should be seen as a necessary step in restoring faith in the rule of law rather than a deviation from it.

As Americans reflect on the implications of Trump’s legal battles, it is crucial to recognize the significance of accountability, especially when dealing with figures who wield immense power. The indictment could represent a shift toward a more robust commitment to upholding the law, ensuring that no individual is allowed to escape justice simply due to their political stature or public influence.

Ultimately, the way in which the country handles Trump’s legal challenges will have long-lasting implications for American democracy. If the rule of law is upheld, the lesson will be clear: no one, not even a president, is beyond the reach of justice.
