New York Appeals Court Declines to Hear Trump’s Challenge to Gag Order in Hush Money Case

The New York Court of Appeals upholds the gag order imposed on Trump in the hush money case.

On Tuesday, the New York Court of Appeals rejected former President Donald Trump’s request to overturn a gag order imposed on him in the hush money case, in which he was convicted last month. The court ruled that no substantial constitutional questions were directly involved in the case, meaning that the gag order, imposed by state Judge Juan Merchan, remains in effect.

Trump had appealed the order, arguing that it infringed on his constitutional rights, particularly his right to free speech during his presidential campaign. His legal team contended that the gag order, which prohibits Trump from attacking witnesses, prosecutors, jurors, court staff, and their families, limited his ability to communicate with voters about matters of public importance. Trump also raised concerns about being restricted in speaking about key witnesses such as his former attorney Michael Cohen and adult film star Stormy Daniels.

However, the Manhattan District Attorney’s office argued that the gag order was necessary to prevent further intimidation and threats stemming from Trump’s inflammatory rhetoric. Prosecutors highlighted that Trump’s past statements had incited violent threats against the DA’s office and trial participants, including Judge Merchan and his staff.

While the Court of Appeals denied the appeal, Trump still has the option to file a motion for reconsideration within the next 30 days. This decision follows his conviction on 34 felony counts of falsifying business records related to the hush money payments.
